Physician Requests Court To Dismiss Johnson & Johnson’s Lawsuit Against Her Research

A medical researcher requests the court to discontinue a lawsuit that Johnson & Johnson filed against her. She had conducted a study in 2019. She carried out a study on how cosmetic talcum products have a link to cancer. 

The medical researcher now claims that her research is scientifically backed. She claims protection under her constitutional free speech.

Dr. Jacqueline Moline is the plaintiffs‘ expert on the subject. She is responsible for more than 200 cases that hold how J&J talc products led to consumers developing cancer.

Media outlets were taken by storm when the news regarding J&J’s talcum product’s link to cancer became public knowledge.

This case saw major developments in a court filing that took place on Friday in the federal court in Trenton, New Jersey.

The medical researcher has claimed that the corporate giant J&J filed the lawsuit to “intimidate” scientific experts.

What Does The First Amendment of the U.S. Constitution Say?

Under the First Amendment of the U.S. Constitution, all scientific conclusions arising out of accurate data are protected.

These conclusions should come from proper data and methodology. Only then will the creators enjoy protections for free speech and academic freedom.

Moline has based her court filing on this clause. 

Following the research, J&J has been facing more than 38,000 lawsuits. All of these class action lawsuits hold that the talc products of J&J can contain asbestos. The list of products includes Johnson’s Baby Powder.

The asbestos content in these products caused various types of cancers in consumers, including ovarian cancer and mesothelioma.

The company says that its talc products are safe and do not contain asbestos.

A subsidiary body of the Corporate giant J&J’s, LTL Management, in turn, sued Moline. In May, they sued her and three other researchers in July. 

Through these lawsuits, they accused them of publishing fraudulent research. The lawsuit also claimed that the research caused J&J’s reputation serious harm.
